我之前介绍过：B1/B2 签证，只要在 I-94 过期前及时提交了延期申请（以 USCIS 签收日期为准、不是以你什么时候寄出申请为准，参见这篇文章解释），那么，只要 USCIS 还没有处理你的申请，在 I-94 过期之后你仍然可以在美国境内合法停留、等待审理结果；不管最后 USCIS 批准、还是拒绝你的申请，这段时间都不会计算 Unlawful Presence「非法滞留」。比如说：
- 你的 I-94 于 2/15 过期
- 你及时提交了延期申请，USCIS 于 2/10 签收
- USCIS 于 8/10 拒绝了你的延期申请
- 你于 9/1 离开美国
从 2/15 到 8/10，因为你有一个 pending application, 所以虽然最后 USCIS 拒绝了你的申请，但这段时间并不计算 unlawful presence —— 「非法停留」从移民局拒绝你的申请之日起计算（不是你收到拒信之日起），即 8/10 – 9/1，远远不足 180 天，因而不会触发3年禁令。
注意：前提是你在 I-94 过期前及时提交了延期申请。如果你的申请提交晚了，USCIS 在你的 I-94 过期之后才收到你的申请，这叫「late filing」，后果会不一样。

今天有读者问，母亲入境后没有给6个月停留、只给了4个月，等到提交延期申请的时候才发现 I-94 已经过期，怎么办？这种「late filing」的情形，如果最终 USCIS 批准、并且 I-94 没有 gap，则一切 ok，但若最后拒绝了，将从 I-94 过期之日、而不是 USCIS 拒绝之日起计算 unlawful presence。比如说：
- I-94 于 2/15 过期
- 申请延期从 2/16 – 8/16，但提交晚了，USCIS 3/1 才收到
- USCIS 于 8/10 拒绝了申请
- 申请人 9/1 离境
虽然从 3/1-8/10 期间有 pending application, 但由于是 late filing, 拒绝之后，unlawful presence 将从身份过期之日（2/16）起计算、而不是从 USCIS 拒绝之日（8/10）起计算。在这个假设的案例中，申请人9/1才离境，unlawful presence 超过180天，3年内将无法入境。
关于这个问题，可参考两份资料：
1、USCIS 2009 年的这份备忘录，讨论了「临时绿卡转正的申请未及时提交」的后果：late filing 如果被拒，申请人将从临时绿卡失效之日起（而不是 USCIS 拒绝之日起）计算 unlawful presence ——「Consequently, if a late filing is accepted and approved while the alien is in proceedings, the alien will not accrue unlawful presence time. If, however, the late filing is rejected, the alien begins to accrue unlawful presence time on the date his or her status as a conditional resident automatically terminated.」虽然是不同的申请类型，但同样的逻辑很可能适用于 B1/B2 延期。
2、纽约移民律所 Scott Legal 官网博客也讨论过这个问题 —— 申请人的 I-94 于 9/20/2020 过期，延期申请提交晚了，若被拒、 unlawful presence 将从 9/21/2020 起计算（而不是从拒绝之日起计算）：
- If USCIS approves your late filing and your extension of status petition, the approval will be backdated and you would have not accrued any unlawful presence. In the example above, if the petition is approved, the approval will be backdated to September 21, 2020 until March 21, 2021.
- If your request for late filing and your extension of status is denied, then you would have been accruing unlawful presence from September 21, 2020.
