Foreign students (F nonimmigrant) generally do not accrue unlawful presence in certain situations, including but are not limited to:[…] During any additional grace period as permitted under 8 CFR 214.2(f)(5)(iv) to prepare for departure:

问：我的妻子在今年 2 月递交了从 f-1 转为 f-2 的 i-539 表格，然后 3 月的时候把 f-1 的身份 terminate 了，按照以前的政策，现在她应该处于 overstay 的状态。我把这个新出的政策仔细读了一下，发现里面没有提及 change of status pending case 算不算非法居留。所以想请问一下，我妻子这样的情况现在算非法居留吗？
答：只要及时提交了 non-frivolous 的延期或 AOS 申请，pending 期间不算 unlawful presence。
