有位读者问道，「你好，我是去年提交了 I-526 EB5 移民申请（还在 pending），但是也还没有到绿卡申请，现在是 F1 Visa，是不是还是算 NRA 呢？关于 form 中有问道「Have you ever applied to be a green card holder (lawful permanent resident) of the United States?」我是应该答 yes 还是 no 呢？」

这位读者所说的「form」应该是 1040-NR，第 5 页 C 项为：「Have you ever applied to be a green card holder (lawful permanent resident) of the United States?」

这个问题 IRS 官方说明如下：

Item C

If you have ever completed immigration Form I-485 and submitted the form to the U.S. Citizenship and Immigration Services, or have ever completed a Form DS-230 and submitted it to the Department of State, you have applied to become a green card holder (lawful permanent resident) of the United States.

也就是说，如果你提交过 I-485（DS-230 一般人用不到），则应回答 yes；反之若尚未提交 I-485，则应回答 no 。以上是我的理解，仅为提供信息之用，不是 legal advice 。
